CMA regulatory review aims to ease the burden on businesses
Consultation launched on whether to remove market remedies, which could benefit more than 10,000 businesses.
The Competition and Markets Authority (CMA)ÌýisÌýlaunchingÌýa reviewÌýofÌýa number ofÌýexistingÌýmarketÌýremediesÌýtoÌýdetermineÌýwhether they areÌýstillÌýrequired,Ìýin a bidÌýto easeÌýtheÌýburdenÌýonÌýthousandsÌýofÌýbusinesses.ÌýThe remedies under review coverÌýseveral sectors including financial services,ÌýtravelÌýand energy.Ìý
Market remedies are designed to fix competition problems identified during market investigations. They play an important role but businesses need to dedicate money and resources to comply with them, so it is important remedies remain fit for purpose.
The CMA excluded remedies from the review that are clearlyÌýcontinuingÌýto deliver impact, includingÌýmeasures aimed at makingÌýsureÌýfamilies have all the information they need when seeking funeral servicesÌý²¹²Ô»åÌýreforms to make it easier for microbusiness customers to switch to a better deal on their energy tariff.
However, theÌýCMAÌýhasÌýidentifiedÌý33Ìýmarket remediesÌý(60% ofÌýall marketÌýremedies in place)Ìýwhich may no longer beÌýneeded toÌýdeal with problems they were designed to fix.ÌýTheyÌýcould, for example,Ìýhave beenÌýsupersededÌýbyÌýnewÌýlaws and regulationsÌýorÌýtechnological advancesÌýthatÌýhaveÌýtransformedÌýhow consumers buyÌýgoodsÌýand services.ÌýÌýÌý
For example, the CMA is considering whether to remove remedies relating to theÌýmarketing practices of large travel businessesÌýthat were introducedÌýoverÌýaÌýdecade ago,Ìýat a timeÌýwhen most travel was booked in-store, which would reduce compliance costs for theseÌýcompanies. Major retail banks could alsoÌýbenefitÌýfrom scrapping rules aroundÌýproviding payment transaction histories to customersÌýwhich they can now easily access online.Ìý
