1.1 ThisService Level Agreement (hereafter referred to as‘this Agreement’)is entered into between theSecretary of State forWork and Pensions of Caxton House, Tothill Street, London, SW1H 9NA and theScottish Ministersof,St Andrew’s House, Regent Road,Edinburgh EH1 3DGacting in some instances through Social Security Scotland.

1.2 References to the Scottish Government(SG), the Scottish Ministers or Social Security Scotland will, asappropriate, be read as also including reference to each of the other entities.

1.3 References to Secretary of State for Work and Pensions shall be read as including reference to the Department for Work and Pensions (DWP), as appropriate and vice versa.

2.Scope and principles

2.1 ThisAgreement sets out the provisions of the relationship betweenScottish Ministersand DWP in relation toCarer Supportand‘theServices’DWP will provide to support this.The Services are described inAnnexes2 to30(b).

2.2 CarerSupportPaymenthas replaced Carer’s Allowance in Scotland from November 2023 with case transfer from Carer’s Allowance to Carer Support Payment now complete. Carer Support Payment will in turn become acomponentof a new benefit called Carer Support from 15 March 2026,for eligible residents in Scotland, as detailed inAnnex 1whichconsists of the followingcomponents:

  • Carer Support Payment which has replaced DWP’s Carer’s Allowance

  • Scottish Carer Supplement whichwillreplace Carer’s Allowance Supplement, for those in receipt of Carer Support Payment.A client is eligible to Scottish Carer Supplement for each award week in which Carer Support Payment is payable

  • CarerAdditional Person Paymentwhich is anadditionalpayment for those with multiple caring roles 

  • Scottish Ministers have increasedthe ‘run on’ of support after a cared for person dies from 8 to 12 weeks

2.3 Under the associated Data Sharing Agreement, DWP and Scottish Ministers will provide necessary data to enable each Party to carry out their obligations.

2.4 DWPandScottish Ministers shallwork in partnership to ensure that the Services are deliveredin accordance withthe terms of this Agreement.

2.5 Thepartnership will seek continuous improvement in delivery standards including sharing lessons from delivery of theServicesinsofar as relevant.

2.6 EachPartywill act transparently and will work in a practical way in regards toreaching mutual agreement on any issues that may arise.

3.ٳܰپDz

3.1 This Agreementshall be effective from andincluding15 March2026(“the Commencement Date”) andcontinue, unlessterminatedearlierin accordance withtheterms.Subject to termination by eitherParty, it shall remain in forceas long asit isrequiredfor Carer Support,(‘the Term’).This Agreement is subject to review by each Party on or before the date twelve (12) months after the date it becomes effective or whendeemedappropriateand agreed by each Party.

3.2 ThisAgreement may be varied,by mutual written agreement ofeachParty atanytimeduring theTerm. Variations to this Agreementwillbe agreed by each Partyand no work will be undertaken until principles for funding theworkareagreed.

3.3 Fortheavoidance of doubt, any variations agreedbetween theparties mustbeput forward in writing and shall form anamendment to this Agreement.

3.4 Inthe event of DWP orScottish Ministers choosing toterminatethis Agreement, DWP and Scottish Ministersshall prepare and agree an appropriate exit plan for the termination of the Services which willseekto ensure no impact on the delivery ofCarerSupport, or reserved benefits impactedbythe delivery of Carer Support.

3.5 EachParty will providetwelve (12) months’ notice of termination in writing.

4.1 This Agreement forms an annex to the ‘Memorandum of Understanding (MoU) between Scottish Ministers (SM) and Secretary of State for Work and Pensions (SSWP) on joint working arrangements covering the implementation of devolved provisions in the Scotland Act 2016 relating to Social Security and Employment Support Services in Scotland’,andis tobe read in conjunction with the following documents,and any subsequent arrangements which are agreed and support this Agreement, insofar as they are not replaced or terminated in the future:

5.Revision to this agreement

5.1 DWP agrees to inform Scottish Ministers as soon as reasonably practicable in advance of any potential changes that may impact on or require changes to the Services.

5.2 EachPartywould need to agree whether a revision to this Agreement isrequired.Subject to Paragraph3.2and 3.3above.

5.3 Any mutually agreed minor changes or amendmentsto this Agreementwill be dealtwith through normal means of communications,bythe single point of contacts (SPoCs).

5.4 Where moresignificant changeisrequired, theSPoCswill apply the appropriateBusinessas Usual (BAU) change control processes. Where the change isagreed,it willbe incorporated into this Agreement as an amendment following any reviewas detailed in 3.2 and 3.3 above.

6.Disputes

6.1 EachParty to this Agreement will notify the other of any issues, concerns or complaintsregardingany matter covered by this Agreement. Wherever possible, these difficulties will be resolved by the process of consultation set out in the ‘SM/SSWP Single MoU’,as referenced in Section 4 (Derivation) of this Agreement.In the event ofa formal escalation of an issue, the process for dispute resolution is outlined in Section 6 of the‘SM/SSWPSingle MoU’.

7.Roles and responsibilities

7.1 ScottishMinisterswill, as set out in this Agreement:

7.1.1 Be responsible for paymentto DWP for‘the Services’inaccordance withParagraph15(Financial Arrangements).

7.1.2 Inform DWP as soon as reasonable practicable if they becomeaware ofany deficiency in the quality of the Services deliveredunder thisAgreement and seekto agree steps to resolve such issues.

7.1.3 Work in partnership with DWP in respect of any potential changesto thedelivery of Carer Support as thesemayimpactonthe Services.

7.1.4 Be responsible for the effective identification and management of risksarising from the delivery of theServices.

7.2 Fortheavoidanceof doubt, each Party acknowledgesthatScottish Ministers shall at all times retaintheresponsibility forCarerSupportand itsdelivery.

7.3 DWPwill,as set out in this Agreement:

7.3.1 Deliver the Servicesin accordance withthis Agreement.

7.3.2 Workin partnership withScottishMinistersin respect of anypotentialimpactsand changes that may affect or require changesto theServices.

7.3.3 InformScottishMinistersas soon as reasonablypracticableiftheybecome aware of any deficiency in the quality of theServices delivered underthis Agreement and take steps to resolve such issues.

7.3.4 Be responsible for the effective identification and management ofrisks arising from the delivery of theServices.

8.Service delivery standards

8.1. TheServiceswill be deliveredin accordance withthe Service Delivery Standards set out below. Contact will be made betweenSPoCsthroughemail inboxes as follows:

8.1.1 Where a customer moves address to Scotland from England or Wales,has been missed/omitted during case transfer or is awarded Carer’s Allowanceretrospectivelyon or after 6November 2025DWP will end their claim,taking into account the13 weekrun-on period,and signpost them to Social Security Scotland to make a new application for Carer SupportPayment/Carer Support.

8.1.2 Where Social Security Scotlandidentify a CarerSupport Payment/Carer Support client has moved to England/Wales, Social Security Scotland will end their award, taking into account the13 weekrun-on period where relevant, and signpost them to DWP to make a new application for Carer’s Allowance, as detailed inAnnex 2.

8.1.3 Wherea clerical Carer’s Allowance claim has been received by DWP after the Commencement Date of Carer Support from a resident in Scotland, DWP will follow the process to provide Scottish Ministers with the relevant information, as detailed inAnnex3.

8.1.5 Where a clerical Carer’s Allowance claim has been received by Social Security Scotland from a resident in Scotland after the Carer Support Commencement date, Scottish Ministers will follow the process to provide DWP with the relevant information, as detailed in Annex 5.

8.1.7 Where there is an existing Carer’s Allowance and/or Universal Credit (Carer’s Element) claim or award, and a new application for Carer Support Payment component of Carer Support is received from a different carer in respect of the same cared for person, Scottish Ministers and DWP will follow the process and provide each other relevant information, as detailed in Annex 7.

8.1.8 Where there is an existing Carer Support Paymentcomponent of Carer Support application or award, and anew claim for DWP’s Carer’s Allowanceisreceived from adifferent carer in respect ofthe same cared for person, Scottish Ministers and DWP will follow the process and provide eachotherrelevantinformation, as detailed inAnnex8.

8.1.10 Where Armed Forces Independence Payment (AFIP) cases are identified, Scottish Ministers and DWP will follow the process to provide each other with relevant information, as detailed in Annexes 10 to 12.

8.1.12 Where an overlapping benefit claim: Unemployability Supplement with Industrial Death Benefit, Severe Disablement Allowance, Maternity Allowance, State Pension, Get your State Pension, Widowed Parent’s Allowance or New Style Employment Support Allowance/Jobseekers Allowance which results in an overpayment and is identified by either Party, that Party will contact the following DWP SPoC. Annexes 14 to 16 and 18 to 21(a).

8.1.13 Where a claim for, Pension Credit which results in an abatement scenario is identified by Social Security Scotland, that Party will contact the following DWP SPoCs. 8.1.18 The turnaround time for responding to dedicated email enquiries relating to the processes, as detailed in Annexes 2 to 9, and Annexes 24 to 24(b) will beas soon as reasonablypracticableand within 5 working days.For any enquiries, which are complex and are off system the turnaround time will be 10 working days.

8.1.21 The turnaround time for responding to dedicated email enquiries relating to appointees will beas soon as reasonablypracticableand within 5 working days, as detailed inAnnexes22to22(c).

8.1.22 Theturnaround time for responding to dedicated email enquiries relating toKeeping Customer Interactions Safe/Unacceptable Actions ControlMeasures will be 2 working days, as detailed inAnnexes23to23(a).

8.1.23 The agent-to-agentemailservice will be available from 8.00amto 6.00pmMonday to Friday excluding Public andPrivilegeholidays.

8.1.24DWP will respond to Social Security Scotland within 24 hours forany exception cases, whichwill be dealt with by SocialSecurityScotland dedicated officers.

8.2 Escalationwill be between SPoCs at team managementlevel,between SocialSecurity Scotland and DWPoperationalteams in appropriate casesincluding,butnot limited to:

8.2.1 WhereService Delivery Standards have not been met.

8.2.2 Where there are cases whenthe normal Service Delivery Standards would have an unacceptable impact on the client.

8.2.3 When Social Security Scotland business continuity plansareinvokedwhich wouldresult ina higher numberofanticipated enquiries to DWP.

9.Fraud

9.1 Fraud processes are being developed in a test and learn environment and are under continuous review by DWP and Social Security Scotland. EachParty should refer to their operational guidance for current processes.

9.2 Theagreed method to transferreferralswill be as detailed in theassociatedData Sharing Agreement.There will be no transfer of referrals that cannot be conducted byemail.

9.3 As soon as eachPartyidentifiesa fraud interest affecting the otherParty, all necessary information shall be sent over as soon as reasonablypracticable, as detailed in the associated Data Sharing Agreement.

9.4 DWP Referrals will be in the form ofa PDFdocument which will be transferred by email.

10.Management review

10.1 EachPartywill act transparently and work in a practical way in the spiritofco-operation, trust, respect and confidentialityin regard toany issues thatmay arise.In general,the working arrangements covered by thisAgreementshould be reviewed at least everytwelve (12)months during the period thisAgreement is in place.Thismay involve meetings between eachParty at aworking level.

11. Evaluation

11.1 EachParty agrees that no personal data will be shared for the purposes ofevaluation.

11.2 ScottishMinisterswill bewholly responsiblefor the evaluation ofCarer Support.EachParty will work together to ensure the agreed service standards are delivered.

12.Complaints

12.1 EachParty will follow their defined Business As Usual Customer/Clientcomplaintsprocedures.

13. Service design and delivery

13.1 It is understood by each Party that the design of the Services will evolve. Each Party agrees to inform the other as soon as reasonably practicable of any changes with its own legislation relating to Carer Support and Carer’s Allowance that may impact on or require changes to the delivery of Carer Support and Carer’s Allowance or the Services.

13.2 Scottish Ministers will deliver Carer Support while seeking continuous improvement in delivery as part of BAU processes. Each Party will work to ensure cost-effective delivery; subject to the overarching financial arrangements as described in the ‘Scottish Devolution: Financial Arrangements for Formal Agreements’ as referenced in Section 4 (Derivation) of this Agreement.

14. Communications

14.1 Communications in relation to Carer Support will be as in the agreed document ‘DWP and SG Joint Communications Framework’ as referenced in Section 4 (Derivation) of this Agreement.

15. Financial arrangements

15.1 DWP will recharge Scottish Ministers agreed costs associated with the delivery of the Services. The agreed financial arrangements and costs are contained in the ‘Scottish Devolution: Financial Arrangements for Formal Agreements’ as referenced in Section 4 (Derivation) of this Agreement.

16.Audit arrangements

16.1 DWP andScottishMinisterswill abide by the principles of audit and accountability asset out in the document‘Scottish Devolution: AFrameworkfor Auditand Accountability’as referenced in Section 4 (Derivation) of thisAgreement.

16.2 DWP andScottishMinistersremainsubject to theiroverallexisting accountabilities to, respectively,theUKand Scottish Parliaments, and their associated audit bodies.

16.3 DWPand Scottish Ministers will abide by the principles in ‘The Agreement between the Scottish Government and the United Kingdom Government on the Scottish Government fiscal framework’ as referenced in Section 4 (Derivation) of this Agreement: Paragraph29whichstatesthat ‘All costs incurred by the UK GovernmentwheretheScottish Government is expected to meet the cost will be subject to Audit’.

17.Data processing

17.1 Further details of the data controller, and roles and responsibilities of Scottish Ministers and DWP in relation to the sharing of personal data, are set out in the associated Data Sharing Agreement.

18.Freedom of information requests, Parliamentary questions, ministerial correspondence and ‘Treat Official’ correspondence

18.1 EachParty is to follow existing processes and obligations forrequests tothatParty and having regard to the‘MoU on Devolution’as well as the‘Concordat betweentheDepartment for Work and Pensionsandthe ScottishGovernment’as referenced in Section 4 (Derivation) of this Agreement.

18.2 EachPartywillassistand cooperate with each other whereappropriate toenable each to meet its obligations.

18.3 This agreement does not supersede any legal obligations under the Freedom of Information Act 2000 (FoIA) and the Freedom of Information (Scotland) Act 2002 (FoI(S)A).

19.Data subject requests

19.1 Wheneither Party receives a right of access request from a data subject requesting copies of data shared by the other Party, they will for any relevant information they hold as an independent data controller and in line with Article 15 of the UK GDPR and ICO’s UK GDPRguidance onthe right of access:

  • confirm that they are processing any such personal data

  • provide a copy of the personal data held; and provide other supplementary information asappropriate

19.2 In addition, ifit appears the data subjectis requesting information held by the other Party, they will alsoatthe same time return the request to the sender with details of the correct address (of the other Party) as soon as reasonablypracticableand within regulatory deadlines. The request itself must not beforwarded.

20.Business continuity

20.1 IfDWP orSocial Security Scotlandbusiness continuity plans are invoked which affectthe Services, theParty invoking their business continuity plan willadvisethe otherParty of the issue, impact and resulting action as soon as reasonably practicable. Individualcontinuity plans are in place in DWP andSocial Security Scotlandand communication points of contact are in place in respective business continuity teams.

21.Technical capabilities

21.1 EachParty will, as soon as reasonably practicable, inform the otherParty of any proposed changes to its IT environment that wouldimpacton the delivery ofCarer Support. EachParty will thereafter cooperate with the other to minimise the impact such changes will have on delivery ofCarer Support[Redacted].

Annex 1-CarerSupportand Components Eligibility conditions

Carer Support Payment began replacing Carer’s Allowance in Scotland from November 2023. It will be replaced from 15 March 2026 with Carer Support, one benefit with three components – Carer Support Payment, Scottish Carer Supplement and Carer Additional Person Payment. Entitlement to Carer Support is based on the provision of care to someone to whom a qualifying disability benefit is normally payable. These qualifying disability benefits are:

  • Child Disability Payment/Disability Living Allowance for children- either middle or highest ratecarecomponent

  • Adult Disability Payment/Personal Independence Payment- either standard or enhanced ratedaily livingcomponent

  • Industrial Injuries Disablement Benefit Constant Attendance Allowanceat or above normal maximum rate with Industrial Injuries Disablement Benefit

  • Scottish AdultDisability Living Allowance/Disability Living Allowance- highest or middle rate care component

  • Pension Age Disability Payment/Attendance Allowance

  • Armed Forces Independence Payment  

  • Constant Attendance Allowance at or above the basic (full day) rate with War Disablement Pension

  • An equivalent qualifying benefit from the European Economic Area (EEA) or Switzerland 

To be entitled to Carer Additional Person Payment an individual must be for each award week:   

  • paid Carer Support Payment

  • providing care for anadditionalcared for person (this is a different person to the Carer Support Payment cared for person) for at least 20 hours weekly and the cared for person must be receiving a qualifying disability benefit

  • care must not be providing by virtue of a contract or as voluntary work but can be carried out concurrently to that of care provided for the purposes of another carer’s award of Carer Support Payment or Young Carer Grant
