Regulations: Enforcement Undertakings accepted by OPSS
Summaries of Enforcement Undertakings from businesses accepted by OPSS and their associated Completion Certificates.
Certain regulations allow businesses to propose Enforcement Undertakings to the Office for Product Safety and Standards (OPSS). These are commitments to take specific actions within specified timeframes in order to address non-compliance.
Enforcement Undertakings are assessed by OPSS on a case-by-case basis and, if agreed, accepted. Decisions are made in line with our Enforcement Policy.

When OPSS is satisfied that the commitments in an Enforcement Undertaking are met, it issues an associated Completion Certificate.
A Completion Certificate can be applied for at any time. When making the application, the business needs to provide sufficient information to enable OPSS to determine that the actions in its Enforcement Undertaking have been completed.
Electric Vehicle (Smart Charge Points) Regulations 2021
The Enforcement Undertakings in the table below have been accepted by OPSS in accordance with the enforcement powers given in Schedule 2 of the Electric Vehicles (Smart Charge Points) Regulations 2021.

Unable to close down
OPSS issues a Completion Certificate when OPSS is satisfied that all actions in an Enforcement Undertaking have been completed. However, in some cases, OPSS is unable to issue a Completion Certificate for an Enforcement Undertaking 鈥� for example where a business is no longer trading or has ceased operations (the company has been dissolved) or cannot be contacted despite reasonable efforts.
In these cases, OPSS will continue to monitor market risk. Where OPSS due diligence indicates that the non-compliant product is no longer being sold, there is no evidence of non 鈥� compliance, and the risk is low, OPSS will not take further enforcement action in respect of the specific breaches covered by the Enforcement Undertaking unless new information becomes available.
In line with OPSS Enforcement Policy and the publication provisions in Part 4 (Publication of enforcement action) of Schedule 2 of the Electrical Vehicles (Smart Charge Points) Regulations 2021, OPSS will publish and retain details of these Enforcement Undertakings on Gov.UK for five years to support transparency. During this period, OPSS will keep the matter under review and may take appropriate action if new information becomes available indicating risk or ongoing non-compliance
