Storing agricultural fuel oil and constructing storage
The regulations farmers and land managers must follow when storing more than 1,500 litres of agricultural fuel oil, such as red diesel and white diesel.

What agricultural fuel oil isÌý
Agricultural fuel oil isÌýfuel oil intendedÌýto produce heat or powerÌýfor agricultural purposes. This is typically:Ìý

red dieselÌýtoÌýoperateÌýtractorsÌý

white dieselÌýfor road vehiclesÌý
It does notÌýincludeÌýoilÌýat your home or business that is stored separately to agricultural fuel oil and is intended for use exclusively:ÌýÌý

for domestic purposes, for exampleÌýheating a farmhouse or other residential premisesÌý
-
for anotherÌýnon-agriculturalÌýbusiness you run from your farmÌý

When you must follow theÌýregulationsÌý
TheseÌýregulationsÌýapplyÌýwhenÌýthe total quantity of agricultural fuel oil stored onÌýyourÌýfarm is more than 1,500 litres.ÌýThis includes whether it’s kept inÌýa single tankÌýor spread across your farmÌýin multiple tanks or drums.Ìý
You must follow the requirements set out inÌýtheÌýregulationsÌýwhenÌýyou’re:ÌýÌý

If you make substantialÌýchangesÌýto theÌýstorage,Ìýit’sÌýno longer exempt.Ìý
The Environment Agency mayÌýalsoÌýserve notice for people toÌýtake action to improveÌýstores if theyÌýconsiderÌýthere’sÌýa significant risk of pollution.Ìý
You must take precautions to ensure thatÌýagricultural fuel oil does not cause pollution.Ìý
NotifyÌýthe Environment Agency about planned new storage or substantial changesÌý
You’reÌýlegally required to notify theÌýEnvironment AgencyÌýat leastÌý14 days before you either:Ìý
- constructÌýnewÌýagriculturalÌýfuel oil storageÌý
- make substantial changes to existing storageÌý
It’sÌýrecommended that youÌýnotifyÌýthe Environment AgencyÌýas early as possibleÌýtoÌýaddress any required changes beforeÌýwork starts.ÌýÌýÌý
The Environment Agency may contact youÌýfor further information. They mayÌýgive you guidance on changes you need to makeÌýto ensureÌýyour storageÌýmeets the regulations.Ìý
YouÌýshould alsoÌýcheck if you need planning permissionÌýfor your storage.
Where to storeÌýagriculturalÌýfuel oilÌý
No part ofÌýyour fuel oilÌýstorageÌýsystem can be within:ÌýÌý
-
10 metres of inlandÌýfreshwatersÌý(including, for example,ÌýanyÌýyard drain, land drain,ÌýstreamÌýorÌýditch, even if it flows for only part of the year)ÌýÌý
-
10 metres ofÌýcoastal watersÌý
The Environment Agency recommends thatÌýyourÌýstorage systemÌýisÌýnotÌýwithin:ÌýÌý
-
50 metres of a borehole, well, or springÌýÌý
-
a groundwaterÌýsourceÌýprotectionÌýzoneÌýoneÌý(SPZ1)ÌýÌý
Check if you’re in a groundwater source protection zoneÌý(SPZ).ÌýÌý
Where this is unavoidable, contactÌýthe Environment Agency.ÌýÌý

Agricultural fuel oil tanksÌýareÌýnormallyÌýsited aboveÌýground.ÌýConsult the Environment Agency if you want to consider installing underground fuel storage tanks.ÌýUnderground tanks must also follow theÌýgroundwater protection codeÌýfor preventing pollution.Ìý
It’sÌýalsoÌýgoodÌýpractice to place tanks:Ìý

away fromÌýany foul or surface-water drainsÌý
-
where the delivery driver can see the filling gaugeÌý
StandardsÌýfor agriculturalÌýfuel oilÌýtanks and drumsÌý
Check with yourÌýsupplierÌýthatÌýyour chosen tank or drumÌýmeetsÌýmanufacturing and quality standards.Ìý
All tanks and drumsÌýmust have a systemÌýto preventÌýleaks and spillsÌýfrom polluting the environment.ÌýThis isÌýaÌýsecondary containment systemÌýcommonlyÌýknown as a bund.ÌýYou may need to construct this.ÌýÌý
If you buy aÌýtank with a combinedÌýsecondary containment system (a bund), make sure itÌýcomplies withÌýSSAFO regulations.Ìý
Tanks,ÌýdrumsÌýand secondary containment systemsÌýmust be designed to last at least 20 years with proper maintenance.ÌýÌý
Secondary containment systems must:Ìý
-
have walls and a base which areÌýimpermeable to oil and waterÌý
-
containÌýevery part of the tankÌýor drumÌý
Taps and valves through which oil can be discharged must be within the bund. They must be directed down into it and locked shut when not in use.ÌýThe bund must notÌýcontainÌýan outlet or a drain.Ìý
Flexible delivery pipes permanently attached to the primary tank must be fitted with a self-closing tap or valve at the end. They must be locked inside the bund when not in use.Ìý
Secondary containmentÌýcapacityÌý
YourÌýsecondaryÌýcontainment systemÌýmust have a minimum capacity. TheÌýcapacityÌýdepends on your type of storage.Ìý
ForÌýsingle tanks, the minimum capacity isÌý110% of the capacity of the tank.Ìý
If you haveÌýmultiple tanksÌýin one area, the minimum capacityÌýisÌýeitherÌýof the following (whichever is greater):Ìý

110% capacity of the largest tankÌý
-
25% of the total volume that could be stored in all tanks in the areaÌý
ForÌýdrums, the minimum capacityÌýisÌýat least 25% of the total volume that could be stored at any time.Ìý
MaintainÌýyourÌýagriculturalÌýfuel oilÌýstorageÌýÌýÌý
It’sÌýrecommended that youÌýroutinely check andÌýmaintainÌýyour agricultural fuel oil store to:Ìý

prevent leaks and failuresÌý
-
make sureÌýthere’sÌýno risk of pollutionÌý
Repair any leaksÌýimmediately. Take out any water or oil that accumulates in the bund and dispose of it safely.ÌýLarge amountsÌýof oil can be removed from water using a blanket that is specially made to absorb oil.Ìý
It’sÌýgoodÌýpractice to:Ìý

inspect tanks,ÌýpipesÌýand equipment regularly for damage and corrosionÌý
-
repaint metal tanks on the outside to prevent corrosionÌýÌý
-
inspectÌýsecondary containmentÌýand keepÌýitÌýin good conditionÌý
Maintain your storeÌýaccording to the manufacturer’s instructions to ensureÌýit will meet the 20-year life expectancy.ÌýÌý
Plan for potential spillsÌý
It’sÌýrecommended that youÌýhave an incident response planÌýand spill kitsÌýinÌýcaseÌýof a spill.ÌýMake sureÌýstaff are fully trained and know what to doÌýifÌýan incidentÌýhappens.ÌýÌý
AllÌýyour oil storage tanksÌýshouldÌýhave anÌýoilÌýcareÌýcampaign stickerÌýthat tells you what to do if you have an oil leak or spill.ÌýCall the Environment Agency’s general enquiries lineÌýfor a free sticker.ÌýÌý

The Environment Agency recommends that you:Ìý

include how to deal with spillages in your accident and emergency planÌýÌý

haveÌýanÌýabsorbent materialÌý(for example sawdust)Ìýavailable to soak up any spillagesÌýÌý

have spill kits available at all locations where oil is stored and usedÌý– make sure staff know how to use themÌý
-
planÌýoperational procedures for deliveries to and from the tank, to minimise the chances of having a spillÌýÌý
-
have a member of farm staff present when fuel is delivered if possibleÌý
-
fit an alarm to alert you to overfillingÌý
-
avoid overfilling vehicle tanksÌýÌý
-
transport,ÌýsiteÌýand use mobile tanks with care, especially when you are refuelling machines such as irrigation pumps next to surface watersÌýÌý
-
check that the fuel systems and tanks of all tractors and diesel engines used in a fixed position are not leaking – use a drip tray as a short-term measureÌý
What to do ifÌýthere’sÌýa spillÌý
If you have a spill,Ìýact straight awayÌýto stop the oil getting into drains or watercourses. If you can, soak up theÌýspilledÌýoil with your spill kit,ÌýsandÌýor earth. Do notÌýput yourself in danger.Ìý
DoÌýnot hose the spill down or use detergents to get rid of it as you could make the pollution worse.ÌýÌý
If oil soaks into the ground, theÌýsoil soaked in oilÌýshould be removed by a professional company. This isÌýso it doesÌýnot cause long-term pollution.ÌýÌý
Store any materials soaked in oil in containers. This isÌýtoÌýcontainÌýtheÌýoil until it can be disposed ofÌýsafely.Ìý
Report pollutionÌý
If there is a pollution incident on your farm, contact the Environment Agency on 0800 80 70 60.ÌýÌýÌý
Reporting incidents can ensure that you getÌýtimelyÌýadvice. This will help to minimise the impact to the environment and your business.Ìý
Disposing ofÌýwasteÌýfuelÌýoilÌý
AnyÌýmaterials contaminated with oilÌýmust be treated asÌýhazardous waste.ÌýThis includesÌýany mixture of oil and water collected in a bund.Ìý
You mustÌýdispose of waste fuel oilÌýwithout causing pollution.ÌýThis includesÌýmixturesÌýof oil and water thatÌýhave collectedÌýinÌýsecondary containment.Ìý
Find outÌýwhat to do withÌýhazardous waste.ÌýÌý
Enforcement and inspectionsÌý
You’reÌýresponsible for preventing pollution if youÌýstore, manage orÌýhandleÌýagricultural fuel oil.ÌýÌý
The Environment AgencyÌýis responsible forÌýenforcing these regulations.ÌýThey doÌýthis through farm inspectionsÌýand incident response.ÌýÌý
If an inspection findsÌýyou’reÌýnotÌýcomplying withÌýthe regulationsÌýÌý
The Environment Agency will usually prioritise giving advice and guidance, specifying the actions you need to take, before taking more formal enforcement action.Ìý
TheÌýEnvironment Agency may take more formal enforcement actionÌýif there’s already pollutionÌýorÌýa significant risk of pollution. This may include:
- servingÌýa notice to improve any unsuitableÌýagriculturalÌýfuel oilÌýstoreÌý
- prosecutionÌýwhichÌýmayÌýresult in a fineÌý
