Definitions

The Regulated Product听notification听in this consultation is a traditional food from a third country.听The following information and definitions may be of use when responding to this consultation.听

Regulated Products听

Certain food and feed products, called regulated products, must go through a risk analysis process, and require authorisation before they can be sold in the UK.鈥痀ou can find out more about the application process, including the risk analysis and risk management processes, and Ministerial involvement here:听Background on placing a regulated product on the market.听

Novel foods听

Novel foods are foods that were not used for human consumption to a significant degree within the UK or EU before 15 May 1997.听In order to听place new novel foods on the GB market or to change the specifications or conditions of use of authorised novel foods, applicants must听submit听an听application听in accordance with听assimilated Regulation 2015/2283.听Background听on听Novel foods authorisation听guidance.听听听

Traditional food notification (鈥楢rticle 14鈥�)听

This is a simplified route to authorise products which have been consumed outside of the UK or EU for at least 25 continuous years before the听notification听is made. Applicants are required to听provide听documented data听demonstrating听the history of safe food use in a third country.听There is a four-month period within which听a safety听review is conducted by听Food Standards Agency听(FSA). If the FSA has no safety objections,听the听product is听authorised听and placed on the authorised list.听

Assimilated Regulations听

Directly applicable EU legislation no longer applies in听Great Britain听(GB).听Any听EU legislation听that was听retained听when the UK exited the EU was assimilated on 31 December 2023. Assimilated law is published on legislation.gov.uk.听听

听is a non-statutory arrangement between the UK Government and Devolved Administrations to听establish听common approaches to policy areas where powers have returned from the EU within areas of devolved competence. This consultation has been developed under the commitments to collaborative four-nation working set out in this Framework. As such, this consultation has been developed through a four-nation approach. Final recommendations will be agreed on a four-nation basis before being presented to Ministers in England,听Scotland听and Wales, with the Northern Ireland Health Minister kept informed. Northern Ireland continues to fully听participate听in the risk analysis processes concerning food and feed safety. This reflects Northern Ireland鈥檚 integral role within the UK and ensures that any听decision made fully considers the potential听impacts on the whole of the UK.听

Risk Management

The FSA听risk management recommendations document听present听the factors that they have identified as relevant to this听notification, including the potential impact of any decision made by听ministers, and听contain听proposed terms of authorisation and other relevant provisions.

Details of consultation

Introduction

This consultation seeks views on the regulated product听notification听for听dried听kenari听nuts (Canarium indicum鈥疞.)听

The FSA is seeking views from stakeholders on the proposed terms of authorisation and any听labelling听requirements.听Stakeholders听are invited to use this opportunity to comment or highlight any听additional听factors that should be brought to the attention of听ministers before听the听notification听is authorised.听

Following the consultation, the next step is for the FSA to write to ministers in England and Wales听regarding听the terms of authorisation and labelling of this product, before placing on the market.听In Scotland, FSS will write to their minister following the consultation,听regarding听the terms of authorisation and labelling of this product, before placing on the market.鈥疢inisters in Northern Ireland will be kept informed.听听

This is in line with FSA听and听FSS responsibility to provide听advice,听information or assistance听to听ministers in respect of matters connected with food safety or other interests of consumers in relation to food (section 6, Food Standards Act 1999 and section 3, Food (Scotland) Act 2015).听Once the听relevant听ministers听are notified of the听authorisation,听they will听take听into account听the risk management recommendations听and听any relevant provisions of assimilated law听raised during the consultation process.

Impacts

As part of the assessment conducted to听determine听whether to raise a duly reasoned safety assessment in line with Article 15, the FSA assessed the safety of this traditional food and the potential impacts arising from its authorisation. No significant safety concerns were听identified.听

Individual detailed impacts, including trade, Northern Ireland, and others, for the notification听is听listed in the corresponding Risk Management听document.听The authorisation of this product should听generally result听in greater market competition, supporting growth听and innovation in the sector.

Background

A notification for the traditional food,听dried听kenari听nuts听(Canarium indicum L.) was submitted听to the FSA for authorisation in Great Britain (GB) in June 2025 by Kawanasi Sehat听Dasacatur, PT.听

For鈥痑鈥痶raditional鈥痜ood鈥痜rom a third country鈥痶o鈥痓e placed on the market in GB, a notification shall be鈥痵ubmitted鈥痠n accordance with鈥�.鈥�鈥�听

Under鈥疉rticle 14鈥痮f the Regulation鈥痶raditional鈥痜oods which have a history of safe use in a third country, as defined by鈥�,鈥痗an be authorised by ministers.鈥疶hese鈥痑uthorised鈥痶raditional foods鈥痺ill鈥痟ave been safely consumed outside of the United Kingdom and the鈥疎uropean Union for at least 25 continuous years before the notification is made.

Trade

Food exported from the UK to other countries/blocs will need to continue to meet the rules of those countries/blocs.

European Union (EU)听

Dried听kenari听nuts (Canarium indicum鈥疞.)听is听already approved for use in the EU.

Northern Ireland听

This product is already authorised for use in Northern Ireland. The authorisation of this product in GB would create alignment with Northern Ireland.

FSA Risk Management Recommendation听

The FSA risk听management recommendation鈥痗oncludes听dried听kenari听nuts听(Canarium indicum鈥疞.)听as described in this notification,鈥痠s鈥痵afe and鈥痠s鈥痭ot liable to have an adverse听effect on the target population, environmental鈥痵afety鈥痑nd human health听with the proposed uses.
